General Conditions of Sale

  1. Purpose

These general conditions define the rights and obligations of the parties in the context of remote booking of services offered by the establishment Château de Salettes on its website, mobile services, or direct booking, on-site or by phone.

They govern all the steps necessary for booking and follow-up between the contracting parties. Any reservation therefore implies the client’s full and unconditional adherence to these conditions.

Every client acknowledges having the capacity to contract, meaning they have reached the legal age of majority and are not under guardianship or trusteeship.

The terms “Establishment” and “website” refer throughout this text to the site named Château de Salettes and corresponding to the domain name accessible at www.chateaudesalettes.com.

The term “client” refers to the person staying at the establishment and to the one who made the payment for the stay if they are two distinct persons.

Preamble COVID-19*

The health crisis that occurred in 2019 leads us to specify that pandemics are considered by our establishment as cases of force majeure. Therefore, cancellations resulting from them do not give rise to any compensation due by the client or the hotel. (Articles 8 and 11 of these general conditions of sale)

  1. Scope

These general conditions of sale apply to all reservations made via the internet, through the website or mobile services, as well as direct bookings. These conditions also apply in case of booking through an intermediary.

  1. Opposability of the general conditions

In any case, the version of the general conditions of sale opposable to the client is the one in force at the time of booking on the website or mobile services or with its partners.

It is generally also annexed to the booking confirmation.

  1. Reservation

Reservations can be made on the website, by phone, by email, or by mail.

The reservation will only be effective if it is guaranteed by the client, either by providing a credit card number with expiration date or by payment of a deposit, and after receipt of a detailed booking confirmation.

Payment for all services will be made directly to the establishment (exceptions made for prepaid reservations at the time of booking). The establishment reserves the right to refuse or cancel any reservation in case the credit card number is incorrect or the reservation is incomplete.

Regardless of their origin, reservations must be paid in euros only.

The establishment accepts the following credit cards: Visa, Mastercard, and American Express, and has a secure booking system (SSL) that protects and encrypts all sensitive data transmitted during the booking to prevent disclosure to a third party.

When registering the reservation, an authorization to debit the credit card will be made.

This will be done for informational purposes only and will not result in any debit from the account except in the following cases:

  • Promotional offer “non-cancellable-non-refundable” for which payment is made at the time of booking.
  • If the expiration date of the credit card is before the arrival date.

The client is solely responsible for their choice of services and their suitability for their needs, so that the establishment’s liability cannot be sought in this regard.

  1. Payment

The client must present themselves at the establishment with the bank card that allowed them to guarantee the reservation or make the prepayment.

The establishment may also ask them to present an identity document for the purpose of preventing credit card fraud.

Payment will be debited at the establishment during the stay, except in the case of special conditions or rates where payment will be debited at the time of booking (online prepayment on certain rates).

This prepayment is qualified as a deposit.

In the case of a non-prepaid rate online, the establishment may ask the client, upon arrival, for a security deposit or authorization to debit the credit card, in order to guarantee payment for the services consumed on-site.

The deposit will be paid by a remote debit from the credit card. The client acknowledges giving their agreement as soon as they accept the terms of the reservation providing for this debit and communicate their card details.

The reservation becomes firm and final only upon receipt of the deposit by the establishment, within the specified time limits.

The payment of the balance of the stay will be made on-site at the establishment.

  1. Modification of stay

Any modification of the reservation must be requested by email to the establishment or by phone. The request will only be effective when the establishment confirms its acceptance in writing.

Any cancellation of the reservation must be requested by email or by phone to the establishment. The request will only be effective when the establishment confirms its acceptance in writing.

Arrival is deemed to be on the first day of the stay at 4:00 p.m. (time of room availability). The calculation of the notice period is therefore based on this schedule.

In case of cancellation of stay, the following conditions apply (except in cases of force majeure):

  • For any cancellation made less than 72 hours before the scheduled arrival date, the full amount of the nights of the reservation will be charged to you. Cancellation requests made more than 72 hours before arrival consequently do not result in the payment of any compensation.
  • In case of non-presentation on the scheduled arrival date, your credit card will be debited with the full amount of the stay. (overnight stay, breakfasts, and a flat rate of €70 per reserved meal).
  • Any stay begun is entirely due.
  1. Force majeure

“Force majeure means any event external to the parties presenting a character both unpredictable and insurmountable which prevents either the client or the hotelier from fulfilling all or part of the obligations provided for in the contract. This is particularly the case in the event of a strike, insurrection, riot, or prohibitions issued by government or public authorities. It is expressly agreed that force majeure suspends, for the parties, the performance of their reciprocal obligations and that each party bears the burden of the expenses resulting from it.”

A pandemic, of the same magnitude as that of the COVID-19 episode, is considered by both parties (establishment and client) as a case of force majeure.

  1. Prices

Prices are indicated in Euros. VAT is always included.

The prices indicated only include the services strictly mentioned in the reservation.

To the price mentioned in the reservation will be added, upon invoicing, the additional services provided by the establishment during the stay, as well as the tourist tax.

The applicable prices are those in force on the day of the reservation. Establishments, as independent professionals, are free to vary their prices at any time. Only the price indicated in the reservation confirmation is contractual.

  1. Complaints, disputes

Any complaint must be made to the establishment within 7 days from the end of the stay.

In the absence of recourse to the conventional mediation procedure or any alternative dispute resolution method within 30 days, each party may refer the matter to the competent judicial authority.

  1. Responsibilities

It is up to the Establishment to take all necessary guarantees and insurance for welcoming the public to its Establishment and for exercising its activity.

The establishment’s liability is limited in case of theft and/or damage to property or objects if these goods were entrusted to its care only in a specific manner.

The client must ensure the safekeeping of their belongings and materials. The client must inform the establishment of any damage they may have caused. They are responsible for all damages caused by them and undertake, in case of damage to the premises made available (room, common areas

Definition of the concept of group:

A group is constituted by an entity (natural or legal person) that reserves, concurrently or not, 2 rooms or more and/or 10 covers or more.

Definition of the concept of stay:

The term “stay” refers to all services included in the quote signed by the client: room, breakfast, meals excluding drinks and tourist tax.

Booking option:

An option can be placed on a date for a pre-reservation. This is always temporary and valid for 7 days unless otherwise stated in the proposal formalized by the establishment’s services. After this period and without news from the client, the option is canceled.

Reservation confirmation:

Any reservation must be confirmed by the signature of the quote accompanied by the mention “Agreed”, these general sales conditions, and by the payment of a deposit of 30% of the total amount including VAT of the quote. These deposits will be deducted from the final invoice or will serve as partial or total payment of any cancellation fees if a cancellation occurs. They are fully refunded in case the establishment is unable to provide the service.

Guarantee of covers and rooms:

The number of meals to be served and rooms must be confirmed 30 days before the event date. This number will be retained as the basis in case of cancellation (see conditions below). The menu type (number of dishes) will be chosen at the time of confirmation. The content will be communicated by the restaurant one week in advance. Regarding the rooms, beyond their number, their type must also be communicated at the time of request and decided 1 month before. This number will be retained as the minimum basis in case of cancellation.

Cancellation:

In case of cancellation concerning the initially confirmed stay, the following indemnities will be charged:

Cancellation 30 days before arrival: indemnities of 30% of the stay or covers retained if it concerns a meal. Cancellation 15 days before arrival: indemnities of 50% of the stay or covers retained if it concerns a meal. Cancellation 7 days before arrival: indemnities of 75% of the stay or covers retained if it concerns a meal. Cancellation less than 7 days before arrival: indemnities of 100% of the stay or covers retained if it concerns a meal.

Special case of renting all rooms:

In case of renting all the rooms of the establishment, the deposits to be paid remain at 30% of the invoice amount. The cancellation conditions that apply are those of the privatization of the establishment. This document is therefore not valid for this case.

Cancellation related to a suspension of our activity or to restrictions on gatherings related to the pandemic:

Regardless of the time between the cancellation and the event: a postponement of up to 18 months is possible. A reassessment of the quote is planned if the postponement is more than 6 months. If cancellation is made at the outset or at the end of the 18 months if no postponement could be scheduled, handling fees apply up to 150€.

Specific information:

We ask the organizer to inform us in advance if any of their guests, for medical reasons, must follow a special dietary regimen. This information must be communicated at least 72 hours before the start of the event.

Exhibitions:

Exhibitions in the public areas of the hotel are subject to prior approval from the hotel. Any installation made by the client must comply with the hotel’s specifications and the latest safety regulations applicable to establishments receiving the public. The organizer undertakes to restore, at their own expense, the premises that have been occupied to their original condition.

Assurance miscellaneous provisions:

The hotel cannot be held responsible for theft or damage to equipment stored by the organizer. The hotel asks the client to take out insurance and to provide security guards during the exhibition period. The organizer is responsible for any damage caused by themselves or their guests during the event. The hotel management reserves the right to cancel the contract if events of force majeure or fortuitous events compel them to do so (strike, fire, water damage). Under no circumstances can the hotel be held responsible for the disappearance of personal items if they are not entrusted to the reception. The shipment of forgotten items will be exclusively at the expense of the client who requests it.

Moral commitment recommendations:

The organizer undertakes to invite only persons whose behavior is not likely to harm the hotel in any way, with the understanding that any material damage or degradation will be invoiced to the organizer. The client may not bring any beverages from outside without obtaining exceptional authorization from the management. Public sales cannot take place in the hotel.

Copyright, payment of SACEM and SPRE rights:

For any event with orchestra, records, or shows, a declaration must be made by the organizer to SACEM, SACEM and SPRE rights must be paid by the client.

Closing time of the establishment:

For any festive event, the organizer must request an exemption from the municipality of the town of Cahuzac sur Vère to deviate from the obligation to close at 1:00 am. This overtime must be planned at the time of conclusion of the contract in order to provide adequate staff.

Credit cards accepted:

CB, Visa, Eurocard, Mastercard, American Express.

Departure:

Rooms must be vacated after breakfast for a seminar, by 11:00 am for family meetings.

Payment terms:

The payment deadlines will be provided in the price proposal. In the absence of specific mention, the balance of the invoice is payable upon presentation of it, on the day of departure. After this date, a late payment indemnity will be calculated monthly at the discount rate of the Banque de France increased by two points. The organizer is responsible for the “extras” of their guests that would not be paid upon their departure and for unoccupied rooms if there is a request for exclusivity of the castle.

Competent jurisdiction in case of dispute:

In case of dispute, the competent jurisdiction is that of the establishment.

Consumer Mediation
